basis, it was stated that the Norwegian Coastal Administration would prequalify 3 to 5 suppliers, assuming a sufficient number
of qualified suppliers. The selection criteria were set to "Competitive dynamics" and "Quality". § 16-12(2) of the Procurement
Regulations sets out requirements that a selection criterion must be objective and non-discriminatory. In addition, the basic
principles in Section 4 of the Procurement Act must be complied with. Beyond this, it is not clear which selection criteria
can be used. Competitive dynamics is mentioned as a possible selection criterion in both the Ministry of Business and Fisheries'
guide to the procurement regulations, and by DFØ at anskaffelser.no. However, after a concrete assessment, the Norwegian Coastal
Administration has come to the conclusion that the way the criteria have been specified in the present competition does not
meet the requirements of the procurement regulations. This is primarily due to the fact that in the qualification basis a
non-exhaustive list of conditions was stated which would be used as a basis for the assessment. The Norwegian Coastal Administration
therefore considers that the criterion was not designed in a way that created the necessary predictability, while at the same
time the list was not sufficiently objective, as the regulations require. Pursuant to the procurement regulations § 25-4 (1),
the Norwegian Coastal Administration has the right to cancel the competition with immediate effect if there is a factual reason.
The fact that the qualification basis does not meet the requirements of the Procurement Act and Regulations is considered
sufficient to cancel the competition. In a competition, the Norwegian Coastal Administration cannot specify the selection
criteria after the deadline for sending requests to participate, and the competition has therefore been influenced by the
design of the criteria. To ensure that it is clear what will be assessed, it is therefore necessary to cancel the competition.
