Avinor (the contracting authority) would like, via this intention notice, to inform the market that they intend to enter into a contract with Finn.no for the publication of job advertisements. The contract will be signed by a procurement without a competition. The intention notice is that the Contracting Authority wants to be transparent and give the market the possibility to object to the above mentioned contract signing. If the Contracting Authority does not receive objections by 05.01.2024, a contract will be signed with Finn.no about publishing job advertisements.Pursuant to implementing a procurement without competition follows from FYF § 9-3 letter b, no. 3. The contracting authority can hold a procurement without a competition for services that only a specific supplier can deliver because the tenderer has the sole right, including intellectual property rights. These exceptions only apply when there are no reasonable alternatives and the lack of competition is not due to the contracting authority having adapted the procurement documents to a specific tenderer. Finn.no is considered to be the only tenderer who can meet the contracting authority ́s need for advertising effect. The contracting authority will depend on reaching out broadly to job seekers within many different disciplines. Among the payment-based online platforms for publishing job advertisements, Finn.no clearly the largest advertising effect, measured in the number of ads, users and professional groups, so that Finn.no operate in practice in a monopoly-like situation. Note that the Contracting Authority has the possibility to enter into other contracts with media agency services, where communication and the procurement of publication of job advertisements is included. The contract period is 5 years and the estimated value of the contract is NOK 12.5 million excluding VAT over 5 years.
